PLACING ORDERS THROUGH THE WEBSITE

By using the KnotCraft website, you acknowledge that you are at least 18 years old. By ordering goods through the website, you make an offer to us to purchase the goods you have selected based on these Terms and Conditions. Information contained on the website constitutes an invitation to treat. No information on the website constitutes an offer by us to sell any goods. KnotCraft reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion. We will confirm acceptance of your order when we send you an email confirming shipment of the goods you have ordered. If we are unable to process or accept your order, we will contact you by email or telephone.

IMAGES AND COLOURS

We have done our best to display as accurately as possible the colours of the products shown on this website. However, because the colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will be accurate. Some of the images on our website are photo-illustrations that have been digitally produced and are not actual photographs. However, we have endeavoured to represent the products as best as possible in these illustrations and have provided actual close-up photographs of the rugs where available.


 

CORRECTION OF ERRORS AND INACCURACIES; LIMITATIONS ON QUANTITY

Whilst KnotCraft makes every reasonable effort to present accurate information, the information may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order). Such errors may relate to product description, pricing and availability. If the price or description of a product is incorrect due to a technical or administrative error, any agreement arising from any acceptance of such offer will, in KnotCraft’s discretion, be void. SALE OF GOODS AND DELIVERY

On your request, we will organise for the delivery of your order to your designated delivery address. Our delivery contractors are various freight companies and couriers. Shipping fees are calculated based on the destination, quantity, and weight of the products. Unless otherwise specified, all prices quoted and sales transactions are in Australian Dollars (AUD). Prices on the website are inclusive of GST. It is expressly agreed and declared that the title to the goods shall not pass to the buyer until payment in full of the purchase price.

INDEMNIFICATION

You agree to indemnify and hold KnotCraft and its employees, representatives, agents, and affiliates harmless from any damage, loss, or expense (including legal costs) incurred by you or by the Parties arising from any claim or proceeding where such loss arises out of your use of the website, any breach by you of these Terms and Conditions, or any goods purchased by you from KnotCraft.

LIMITATION OF LIABILITY

In no event shall KnotCraft or any of its affiliates be liable for any indirect, special, incidental or consequential damages including but not limited to loss of business or profits. To the maximum extent permitted by applicable laws, KnotCraft’s liability is limited to an amount equal to the purchase price of the relevant good(s). KnotCraft does not accept liability for: any damage or injury caused by the use or misuse of products; errors or inaccuracies on the website; or any interruption of transmission to or from the website.

STATUTORY CONDITIONS AND WARRANTIES

Statutory conditions and warranties apply under Australian Consumer Law. Nothing in these Terms and Conditions excludes the application of those statutory conditions and warranties.

RETURNS AND CREDITS

Any goods purchased from the website may only be returned to KnotCraft where notification of the proposed return is received within seven (7) days of the date of delivery. Returns are subject to the goods being in original, unused condition and in original packaging. No claims for loss or damage in transit or for shortage in quantity will be entertained unless notice is given in writing within seven (7) days from date of delivery. Goods accepted as defective will be replaced or refunded at the invoiced value. KnotCraft will not accept liability for any loss or damage in respect of any failure to deliver or delay in delivery due to causes outside of our control.

MISCELLANEOUS

These Terms and Conditions are legally binding and governed by and construed in accordance with the laws of the State of New South Wales. Each party submits to the exclusive jurisdiction of the Courts of New South Wales. If any part of these Terms and Conditions is found to be void or unenforceable, that part will be deemed severed and will not affect the validity and enforceability of the remaining provisions.
